Tebogo Malatji, Public Enterprises Minister Pravin Gordhan’s lawyer has hit back at Mkhwebane claiming that she failed to produce factual information of how the South African Revenue Services (Sars) “rogue” unit was established.

In her report, Mkhwebane stated that Gordhan violated Section 41(1) of the Constitution when he established the unit in 20017 during his post as the revenue collector’s commissioner.

On Wednesday night, in a statement, Gordhan’s lawyers announced that the Minister lodged legal action against Mkhwebane to have all remedial action against him from the report to be suspended urgently.

“It’s the failure to investigate facts, so that’s the one element. The other element of it is the clear misconstruction and misunderstanding of the legal prescripts applicable to each of these scenarios and we say that’s a matter of concern,” said Malatji.

  1. The public protector is a destruction force that need unnecessary attention. She was busy with ramaphosa. Gordan but failed to investigate magashule and zwane plus many more who looted from the public purse. She is not fit to hold office. She is doing the opposite of what she is supposed to do
